For all deliveries of Om Movement- a brand of Om Distribution Germany (hereinafter to consumers, these General Terms and Conditions (GTC) apply.
A consumer is any natural person who enters into a legal transaction for a purpose that can predominantly be attributed neither to his commercial nor to his independent professional activity.

3. conclusion of contract

The presentation of the products in the online store does not constitute a legally binding offer, but only an invitation to order.
By clicking the button [Buy/order with costs] you place a binding order for the goods listed on the order page. Your purchase contract is concluded when we accept your order by sending an order confirmation by e-mail immediately after receiving your order.

4. right of revocation

If you are a consumer (i.e. a natural person who places the order for a purpose that cannot be attributed to your commercial or independent professional activity), you have a right of revocation in accordance with the statutory provisions.
If you, as a consumer, make use of your right of revocation pursuant to Section 4.1, you shall bear the regular costs of the return shipment.
You have the right to cancel this contract within fourteen days without giving any reason.The cancellation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the goods. In order to exercise your right of withdrawal, you must inform us [enter the name of the entrepreneur, address and, if available, telephone number, fax number and e-mail address] by means of a clear declaration (e.g. a letter sent by post, fax or e-mail) of your decision to withdraw from this contract. You may use the enclosed model withdrawal form for this purpose, which is, however, not mandatory. If you make use of this option, we will send you a confirmation of receipt of such revocation without delay (e.g. by e-mail).To comply with the revocation period, it is sufficient that you send the notification of the exercise of the right of revocation before the expiry of the revocation period.

Consequences of the revocation

If you revoke this contract, we shall reimburse you all payments we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the most favorable standard delivery offered by us), without undue delay and no later than within fourteen days from the day on which we received the notification of your revocation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees because of this repayment. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

You must return or hand over the goods to us without undue delay and in any case no later than within fourteen days from the day on which you notify us of the revocation of this contract. The deadline is met if you send the goods before the expiry of the period of fourteen days.

You shall bear the direct costs of returning the goods.

You will only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking the condition, properties and functioning of the goods.

5. prices and shipping costs

The prices stated on the product pages include the statutory value added tax and other price components.
In addition to the stated prices, we do not charge shipping costs within the EU.
In case of payment by cash on delivery, an additional fee in the amount of 2.- Euro is due, which is charged by the local deliverer. Further taxes or costs do not apply

6. delivery

Delivery Worldwide with DHL.
The delivery time is generally 3 days up to 7 days. On possibly deviating delivery times we point out on the respective product page. Should there be delivery delays with DHL, such as due to COVID 19, we have no influence on it.

7. payment

Payment is made with all payment methods specified by us.
If you choose payment in advance, we will give you our bank details in the order confirmation and deliver the goods after receipt of payment.

8. retention of title
The goods remain our property until full payment has been made.


9. dispute resolution
The EU Commission has created an Internet platform for online dispute resolution. The platform serves as a contact point for the out-of-court settlement of disputes concerning contractual obligations arising from online purchase contracts. More information is available at the following link:  We are neither willing nor obliged to participate in a dispute resolution procedure before a consumer arbitration board.

10. batteries
Om Movement watches are of course shipped with batteries. These can be returned to us at the end of their life. We guarantee a professional and environmentally friendly disposal of the batteries. Batteries containing harmful substances are marked by chemical symbols (Cd for cadmium, Hg for mercury, Pb for lead). Pb=battery contains lead, Cd = battery contains cadmium, HG = battery contains mercury. Please never dispose of batteries in household waste.

11. warranty conditions
The warranty is only granted to consumers, not to companies, whereby a consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to his commercial nor to his independent professional activity.
The period for calculating the warranty period of 24 months begins with the invoice date. Our warranty is valid worldwide. If defects occur in our products during this period, we, as the guarantor, will provide you with one of the following services within the scope of the guarantee, at our discretion:

repair of the goods free of charge or
free replacement of the goods with an equivalent article (if necessary also a successor model, if the original goods are no longer available).

Warranty claims are excluded in the case of damage to the goods that have arisen due to:

misuse or improper handling of the goods, in particular resulting breakage and glass damage
environmental influences (humidity, extreme cold or heat, overvoltage, dust, etc.), especially damage caused by moisture and water
non-observance of any safety precautions
non-observance of the operating instructions
use of force (e.g. impact, shock, falling)
unauthorized repair attempts

Excluded from the warranty are changes in the color of the goods (patina, color, structural changes, e.g. due to great heat or moisture) and watch straps that are not made of stainless steel.

A claim under warranty requires that you allow us to examine the warranty claim by sending in the goods. In doing so, it is important to ensure that damage to the goods during transport is avoided by using appropriate packaging.

To apply for warranty service, you must enclose a copy of the original invoice of the goods shipment. We ask for your understanding that we can refuse the warranty service without enclosing this copy of the invoice, because the sending of the copy of the invoice serves for the calculation of the warranty period.

If the warranty claim is justified, we will provide the warranty service within 30 days from the date of dispatch of the goods to us.
The freight costs for sending the goods to us as well as for returning the goods to you shall be borne by us and reimbursed by us within the scope of the warranty service.
However, you bear the risk of deterioration or loss in transit of the goods sent in or returned to you by us under the warranty service.

Your statutory rights against us, from the purchase contract concluded with us, are not limited by this warranty promise in any way. In particular, any existing statutory warranty rights against us remain unaffected by this warranty promise.
If the purchased item is defective, you can therefore always claim against us under the statutory warranty, regardless of whether a warranty case exists or the warranty is invoked.
